These terms of use regulate the use of the simple8 website, the demo, the documentation as well as the API and services of 29links GmbH, unless expressly different contractual agreements are made in individual cases.
Individual offers, orders, service descriptions, order processing contracts and service level agreements take precedence over these terms of use to the extent that they expressly regulate the same subject matter differently.
The offer is aimed exclusively at entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law.
simple8 provides functions for language simplification, related settings, demo interfaces, documentation and technical interfaces. The specific scope of services results from the agreed product and price description.

The customer ensures that only authorized persons and systems receive access. Suspected cases of misuse, loss or unauthorized disclosure must be reported to simple8 immediately.
simple8 is entitled to temporarily block or rotate access if there are specific security risks, indicators of misuse or significant disruptions to operations.
Use is only permitted to the agreed extent and for the customer's own operational or official purposes. Resale, sublicensing, operation as a generic third-party service or a reseller model require a separate written agreement.
In particular, unlawful content, circumvention of technical protective measures, automated load tests without approval, security attacks, use to develop competing models or services and any use that violates the rights of third parties are not permitted.
For operations with increased risk, particularly in regulated or fundamental rights-relevant contexts, the customer must ensure appropriate human review, professional quality assurance and its own compliance review.
The customer is solely responsible for the origin, admissibility, chain of rights, correctness of content and admissibility under data protection law of the content transmitted by the customer.
simple8 processes customer input, settings, metadata and results to the extent necessary for performance, security, error analysis, cache logic, misuse protection and contractually agreed operational purposes.
Unless otherwise agreed between the parties, the customer may use the results generated for him for the contractually intended purposes. Rights to the platform, the software, models, methods, documentation and all pre-existing components remain with simple8 or the respective rights holders.
Automatically generated results may vary depending on the model. They do not replace technical examination, legal assessment or final editorial approval.
Planned maintenance windows, security-related interventions, updates, model adjustments and infrastructural changes may be carried out to the extent necessary to maintain, improve or secure the service.
simple8 can set appropriate technical usage limits, in particular for request volume, parallelism, rate limits, payload sizes and misuse protection.

The individually agreed prices, terms and billing models apply. Unless otherwise stated, all prices are exclusive of VAT.
Unless otherwise agreed, invoices are due without deductions within the period stated on the invoice. In the event of late payment, simple8 can assert statutory default rights and temporarily restrict services after prior notice.
A right of retention or offsetting is only permitted with undisputed or legally established counterclaims.
simple8 guarantees the usual level of care in a professional SaaS environment. There is no claim that all editions are free of errors, that they are suitable for each individual case or that there are no model-related deviations.
simple8 is liable without limitation in the event of intent, gross negligence, injury to life, body or health, in accordance with the Product Liability Act and in cases of mandatory statutory liability.
In the event of a slightly negligent violation of essential contractual obligations, liability is limited to the foreseeable damage that is typical for the contract. Furthermore, liability for slight negligence is excluded. Liability for indirect damages, consequential damages, lost profits or lack of savings only exists if mandatory law provides for this.
Terms and notice periods depend on the respective order or offer. The right to extraordinary termination for good cause remains unaffected.
simple8 may temporarily block services if there is a significant violation of these terms of use, a security incident, a delay in payment or a specific risk to infrastructure, third parties or legal positions.
To the extent that it is reasonable, simple8 will inform you before blocking and give you a reasonable opportunity to remedy the situation. If there are acute security or legal risks, the blocking may take place immediately.
If simple8 processes personal data on behalf of the parties, the parties will conclude an order processing contract if necessary. In addition, the data protection declaration applies to processing for which simple8 itself is responsible.
Both parties treat the other party's confidential information with reasonable care and use it only for the contractually intended purposes.
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from or in connection with use is, to the extent permitted by law, Stuttgart. If individual provisions are or become ineffective, the effectiveness of the remaining provisions remains unaffected.
